GOLF CART RENTAL AGREEMENT

This Golf Cart Rental Agreement (the "Agreement") is made and entered into by and between Carolina Golf Cart Rentals LLC, a North Carolina limited liability company, with its principal place of business located at 8840 River Rd., Grifton, NC 28530 ("Owner"), and (“Customer”), an individual or entity. This Agreement is effective as of the date it is signed by both parties.

 

1. RENTAL OF GOLF CART(S)

Owner agrees to rent to Customer, and Customer agrees to rent from Owner, the electric golf cart(s) described in the attached Rental Order (each, a "Golf Cart"). The Rental Order will specify the number of carts, the rental period, and the rental rate, and is incorporated into this Agreement by reference.

 

2. RENTAL TERM AND RETURN

The rental period for the Golf Cart(s) will begin on the date of delivery (as specified in the Rental Order) and will end on the date of return specified in the Rental Order or when the Golf Cart(s) are returned to the Owner, whichever is earlier. Customer agrees to return the Golf Cart(s) to Owner in the same condition as received, except for normal wear and tear.

 

3. RENTAL FEES AND PAYMENT

• The rental fee for the Golf Cart(s) will be as specified in the Rental Order.

• Customer agrees to pay the rental fee in full before or upon delivery of the Golf Cart(s).

• Payments: Payments are accepted in cash or via credit/debit card. A late payment fee of 10% per month may be charged on any overdue balance.

• Late Returns: Late returns will be charged an additional fee of $10 per hour.

 

4. USE OF GOLF CART(S)

• Age of Operators: Only individuals who are at least 18 years of age and hold a valid driver’s license are permitted to operate the Golf Cart(s). Customer is responsible for ensuring that all operators of the Golf Cart(s) are properly licensed and informed of safety protocols.

• Age to Rent: The Customer must be at least 21 years of age and hold a valid drivers license to rent the Golf Cart(s).

• Prohibited Uses: The Golf Cart(s) shall only be used for lawful purposes, and Customer agrees not to:

  • Operate the Golf Cart(s) under the influence of alcohol, drugs, or any other impairing substance.

  • Allow anyone to drive the Golf Cart(s) who does not have a valid driver’s license.

  • Operate the Golf Cart(s) outside of the designated area or on public streets unless authorized by local law.

  • Allow more passengers than the Golf Cart(s) are designed to carry.

  • Use the Golf Cart(s) for any commercial purpose unless otherwise agreed in writing.

   

• Safety and Operational Guidelines:
  Customer agrees to follow all safety instructions provided by Owner, including but not limited to:

  • Always wearing a seatbelt (if so equipped).

  • Not exceeding the maximum person or weight capacity of the Golf Cart.

  • Not using the Golf Cart(s) in hazardous conditions (e.g., inclement weather, rough terrain).

  • Operating the Golf Cart(s) in a safe manner at all times to prevent injury or damage.

 

5. MAINTENANCE AND CARE OF GOLF CART(S)

• Customer’s Responsibility: Customer agrees to take reasonable precautions to maintain the Golf Cart(s) in good working order during the rental period, including charging the Golf Cart(s) as needed and inspecting tires and other components.

• Routine Maintenance: Customer agrees to perform basic maintenance such as recharging the Golf Cart(s) and checking tire pressure. Customer must immediately notify Owner of any mechanical issues, damages, or malfunctions.

• Owner’s Responsibility: Owner will ensure that all Golf Cart(s) are in good condition at the start of the rental period. If a Golf Cart requires significant repair or maintenance during the rental period, Owner will repair the Golf Cart(s) at no cost to Customer unless caused by Customer’s misuse.

 

6. DAMAGE AND LIABILITY

• Responsibility for Damage: Customer is responsible for any damage to or loss (including theft) of the Golf Cart(s) caused by misuse, negligence, or failure to return the Golf Cart(s) in the condition in which they were rented (excluding normal wear and tear). If the Golf Cart(s) are damaged beyond repair, lost, or stolen, Customer will be responsible for the full replacement cost of the Golf Cart(s). Customer agrees contact owner immediately and notify them of any damage or other problems with golf cart. Customer agrees to permit Carolina Golf Cart Rentals LLC to charge any credit or debit card on file for damages done to Golf Cart(s) that is above normal wear and tear, subject to Owner's discretion. If no damages are found, the security deposit (if required) will be refunded in full.

• Insurance: No liability coverage is offered or implied by owner.  Liability coverage is available from 3rd party providers. Customer agrees to maintain general liability insurance covering the use of the Golf Cart(s) during the rental period, if so required by township, campground, venue, ect.  Customer agrees to name Owner as an additional insured under the policy. A certificate of insurance must be provided to Owner upon request.

• Indemnification: Customer agrees to indemnify, defend, and hold harmless Carolina Golf Cart Rentals LLC, its affiliates, officers, employees, and agents from any and all claims, damages, liabilities, and expenses (including attorney’s fees) arising from or related to the use, operation, or possession of the Golf Cart(s) during the rental period. This includes any injuries, damages, or losses to third parties.

• Liability Waiver for Personal Injury: Customer acknowledges that there are risks associated with operating the Golf Cart(s) and voluntarily assumes all risks related to the use of the Golf Cart(s). Customer agrees to waive any claim for personal injury, death, or property damage that may arise from the operation of the Golf Cart(s).

 

7. ELECTRICAL SYSTEM AND CHARGING

• Battery and Charging: Customer is responsible for ensuring the Golf Cart(s) are sufficiently charged for use during the rental period. The Owner will provide the necessary charging equipment and instructions at the time of rental. If the Golf Cart(s) run out of charge, Customer will be responsible for recharging them, and any downtime caused by the need to charge the Golf Cart(s) will not reduce rental fees. Customer agrees to return Golf Cart(s) charged sufficiently as to be able to load them on transport trailer at pickup time. Golf Cart(s) with depleted batteries that must be towed or winched onto trailer will incur an additional fee of $25.

 

8. INSPECTION AND RETURN

• Pre-Rental Inspection: Customer acknowledges that they have inspected the Golf Cart(s) prior to taking possession and have found the Golf Cart(s) to be in good working order.

• Return Condition: Upon return, the Golf Cart(s) will be inspected by Owner for damage or loss. Customer will be notified using contact information provided on rental agreement within 48 hours of any additional charges for damages or late returns. Customer agrees contact owner immediately and notify them of any damage or other problems with golf cart. Customer agrees to permit Carolina Golf Cart Rentals LLC to charge any credit or debit card on file for damages done to Golf Cart(s) that is above normal wear and tear, subject to Owner's discretion.

 

9. TERMINATION

Owner may terminate this Agreement and repossess the Golf Cart(s) if:

• Customer breaches any term of this Agreement, including failure to make timely payments or failure to return the Golf Cart(s) on time.

• The Golf Cart(s) are used in violation of local laws or ordinances.

• The Golf Cart(s) are deemed unsafe by Owner due to misuse or neglect by Customer.

 

10. FORCE MAJEURE

Owner shall not be held liable for any delay or failure in performance of any of its obligations hereunder due to causes beyond its reasonable control, including but not limited to natural disasters, power outages, or governmental actions.

 

11. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina. Any disputes arising out of or relating to this Agreement will be resolved through binding arbitration in Craven County, North Carolina, under the rules of the American Arbitration Association.

 

12. CANCELLATION POLICY

• Customer must notify Owner of any cancellation or reschedule at least 48 hours before the rental period begins. Cancellations made after this period will incur a 25% cancellation fee. No refunds will be issued for cancellations within 24 hours of the scheduled rental, unless other agreement with Carolina Golf Cart Rentals, LLC has been made. Customer must contact us by phone or in person in this case.

 

13. PRIVACY AND DATA PROTECTION

Customer’s personal information will be collected for the purpose of processing the rental transaction and ensuring proper billing. Owner will take reasonable steps to protect Customer’s information but is not liable for any breach of security beyond their control.

 

14. AMENDMENT OF TERMS FOR FUTURE RENTALS

Owner reserves the right to modify the terms of this Agreement for future rentals. Any such changes will be communicated in writing to the Customer and must be agreed to by the Customer before the next rental period begins.

 

15. USE OF CART FOR UNAUTHORIZED PURPOSES

Customer agrees that the Golf Cart(s) shall not be used for any unauthorized or reckless purposes, including but not limited to racing, stunts, off-road usage, or transporting hazardous materials. Cart may not be sub-leased or rented out by the customer.  Any such misuse will result in immediate termination of the rental, and Customer will be responsible for any damages, costs, or liabilities arising from such misuse.

 

16. ENVIRONMENTAL AND WEATHER POLICY

Customer agrees not to use the Golf Cart(s) during extreme weather conditions, such as thunderstorms, snow, or excessive heat, which may negatively impact the operation of the carts. Owner is not responsible for any performance issues related to weather conditions.
